Terms of use

These are the terms for using Magpie. They are short on purpose. By using the app you agree to them.

The short version

  • A valuation is an estimate, not advice and not a guarantee.
  • One credit is one appraisal. Credits never expire, cannot be transferred and have no cash value.
  • Purchases are made through Apple or Google, which handle payment and refunds.
  • You can delete your account at any time.
  • English law applies, and your rights as a consumer where you live are not affected.

1. Who we are

Magpie is provided by Weftworks Limited, a company registered in England and Wales, number 17439248, of 2 Ravenscroft Gardens, Trowbridge, Wiltshire, BA14 7JU. In these terms “we” means Weftworks Limited and “Magpie” means the app and the service behind it.

2. What Magpie does

You photograph an object. Magpie tells you what it probably is, what similar things recently sold for, and, if you give a ticket price, whether it looks worth buying.

3. Estimates, not advice

Everything Magpie tells you is an estimate made from photographs and from public records of recent sales. It is not a professional valuation, and it is not advice to buy or sell.

Magpie cannot handle the object. It cannot confirm that an object is genuine, find hidden damage or a repair, or know that a part has been replaced. It can be wrong about what the object is and about what it is worth. Every answer shows how confident it is, and you should read that before you rely on it.

The decision to buy or sell is yours. For anything valuable, or anything you need valued for insurance, probate or sale, ask a qualified valuer.

4. Your account

You need an account to use Magpie, and you sign in with Apple or Google. You must be at least 13. Keep your Apple or Google account secure, because anyone who can sign in to it can use your credits.

An Apple sign-in and a Google sign-in are separate accounts, and we cannot merge them.

5. Credits

One credit is one appraisal. A new account starts with three free credits. After that you buy credits in bundles in the app.

  • Credits never expire.
  • Credits belong to your account. They cannot be transferred to another account, sold or exchanged for money.
  • A credit is used when an appraisal returns an answer. No credit is used when an appraisal fails or when Magpie cannot look at the photograph.
  • If you delete your account, any unused credits are lost and are not refunded.

The free credits are one set per person. We may refuse or remove them where an account appears to have been made to collect them again.

6. Purchases and refunds

Purchases are made through Apple on iPhone and through Google Play on Android, each of which takes payment under its own terms. Prices are shown in the app before you buy and include any tax that applies.

Credits are digital content supplied as soon as you buy them. By buying, you ask for them to be supplied at once and accept that the usual right to cancel within 14 days ends when they are added to your account.

Refunds are handled by Apple, at reportaproblem.apple.com, or by Google Play, in its order history. If a purchase is refunded, the credits it bought are removed from your account. If something went wrong with an appraisal, write to us and we will put it right.

Nothing in these terms affects your legal rights if what you bought is faulty or not as described.

7. Using Magpie fairly

You agree to:

  • photograph only things you are entitled to photograph, and send nothing unlawful or indecent;
  • use Magpie through the app, and not by automated means;
  • not try to get round its limits, interfere with it, or find out how it is built beyond what the law allows.

We may suspend or close an account that breaks these terms.

8. The service

We work to keep Magpie running, but we do not promise that it will always be available or free of errors. It depends on services we do not control, including sources of sold prices. We may change or improve it, and we will not reduce what your paid credits can do without telling you first.

If we ever close Magpie, we will give reasonable notice in the app so that you can use your credits.

9. Our responsibility to you

If we fail to keep to these terms, we are responsible for loss you suffer that is a foreseeable result of that. We are not responsible for loss that is not foreseeable, for business losses, or for a decision to buy or sell made on an estimate. Where the law allows, the most we will owe you in connection with Magpie is the amount you paid us in the 12 months before the claim.

We do not exclude or limit our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude.

10. Your data

The privacy policy explains what we collect and how to delete it.

11. Changes

We may change these terms. If a change matters, we will tell you in the app before it applies. The date at the top of this page shows when they last changed.

12. Law

These terms are governed by the law of England and Wales. If you are a consumer living elsewhere in the United Kingdom or in the European Union, you keep the protection of the mandatory laws of the place where you live, and you can bring a claim in your local courts.
